Terms of commissions
It’s never the fun stuff but it does protect everyone from confusion.
Please read all the below terms before contacting for a commission, its boring but only takes a minute
Description of product
Drawing produced with graphite pencils on heavy weight paper. The finished product will be protected with a fixative spray to prevent damage to the work. The work will be based on a photograph provided by the client. The artist has the right to turn down the commission if a high quality photo cannot be provided.
Photograph rights
If the reference photograph is not the client’s own, the client must obtain permission from the owner of the photograph. If the photograph was taken by a professional photographer, the client must obtain permission from the photographer.
Payment terms
Payment can be made by bank transfer or Paypal. A 25% deposit is required to secure the booking before starting the drawing – this deposit is non-refundable once the drawing has been started. The balancing payment is required before delivery of the product. If the client is unhappy with the finished result, and it cannot be resolved through minor alterations, then the balancing payment will not be required, however the client will not be given the drawing.
Target dates and delivery
A target date will be agreed before starting the drawing. If shipping is needed (due to distance or country) then this will be carried out as soon as possible. From the point of shipping, the length of time it takes to arrive is no longer the artist’s responsibility but tracking references will be given where provided.
Delivery of the product
Shipping cost is always included in the full price of the drawing but it is essential that you pay the cost relating to the country the art is travelling to. Once shipped the client will be given a tracking number where this has been provided. Protective packaging will be used. NB: Payment of import duty and/or taxes (VAT for example) may be required in some countries, which is the responsibility of the client to determine and pay however non payment if requested by customs may result in not receiving art, in this instance a refund will not be issued.
Returns & Damage in transit
If the drawing is damaged in transit, the client must get in touch with an artist of the damaged artwork within 24 hours of receiving it. We will then discuss the best course of action for the particular situation. If a new one is required, this will be completed at the soonest opportunity within the artist’s waiting list.
If a minor alteration is required after receipt of the drawing, the client must contact the artist within 7 days. Delivery costs both ways are the client’s responsibility as the sign off will have already taken place prior to delivery.
Copyright
The artist retains the copyright of the art produced, so therefore has the right to use an image of the work for portfolios, this website, any print editions and social media*. The client does not have the right to sell copies of the work in any way without permission from the artist.
Data Protection
The artist will need to collect the following information: the client’s name, email address and address. This information will only be used to send invoices and to deliver the product. The client’s name will be stored to keep track of orders. Should you wish to remain on any newsletters or be kept informed of future promotions then the clients name and email address will be securely stored for such use. The clients details will never be shared with any third party.
*if the portrait is a gift, an image of the work will not be published on social media or this website until the gift has been received
